        Synod Estimates Ordinance 1999

        No 42, 1999

        An Ordinance to adopt financial estimates for 2000 to 2002, to authorise appropriations and allocations for 2000 and to state the Synod’s intentions for appropriations and allocations for 2001 and 2002.

        Whereas -

        A. The Mission Statement of the Archbishop-in-Council is -

        “Our mission is to glorify God through Jesus Christ by developing individuals and churches who are -

            · observably God’s people

            · pastorally effective

            · evangelistically enterprising

            · genuinely caring

            · dynamically Anglican

        in order to participate in God’s purpose of saving His world.”

        B. Clause 3 of the Synod Estimates Ordinance 1998 contemplates that the 1st session of each Synod will consider a proposed ordinance which contains certain financial estimates for each of the following 3 financial years.

        C. This Ordinance adopts financial estimates for 2000, 2001 and 2002, authorises appropriations and allocations for 2000 and states the Synod’s intentions for appropriations and allocations for 2001 and 2002.

        The Synod of the Diocese of Sydney Ordains -

        1. Name

        This Ordinance is the Synod Estimates Ordinance 1999.

        2. Declarations

        By reason of circumstances that have arisen after the creation of the trusts of each of the amounts referred to in the column headed “2000 Proposed” in the 1st Schedule, it is inexpedient to carry out and observe those trusts or to apply those amounts solely for the same or like purposes as the trusts on which those amounts are presently held.

        3. Adoption of Estimates

        The estimates for 2000, 2001 and 2002 set out in the columns of the 2nd Schedule headed “2000", “2001", “2002” are adopted.

        4. Appropriations and Allocations for 2000

          (1) Under clause 4 of the Diocesan Endowment Ordinance 1984, the Synod directs that -

            (a) the amount referred to alongside the matter “Diocesan Endowment Ordinance 1984" in the column headed “2000 Proposed” in the 1st Schedule be paid by the Glebe Administration Board to the Standing Committee during 2000; and

            (b) the amount so paid shall be applied by the Standing Committee towards the allocations in the column in the 2nd Schedule headed “2000", in the manner further particularised in the line item schedules forming part of the Standing Committee’s report to the Synod.

          (2) The Synod directs that the other amounts referred to in the column headed “2000 Proposed” in the 1st Schedule also be applied towards the allocations in the column in the 2nd Schedule headed “2000", in the manner further particularised in the line item schedules forming part of the Standing Committee’s report to the Synod.

        5. Appropriations and Allocations for 2001 and 2002

          (1) The Synod intends -

            (a) subject to clause 7, in 2001 and 2002 the respective amounts referred to in the columns headed “2001 Estimate” and “2002 Estimate” in the 1st Schedule will be appropriated from the relevant trusts and allocated towards the estimates for the relevant year in the 2nd Schedule, in the manner further particularised in the line item schedules forming part of the Standing Committee’s report to the Synod;

            (b) if the total amount available to be appropriated in 2001 or 2002 from the trusts listed in the 1st Schedule is less than the total amount to be allocated towards the estimates for the relevant yearin the 2nd Schedule, an amount equal to the amount of the deficiency will be appropriated from the provision for distribution held by the Glebe Administration Board under the Diocesan Endowment Ordinance 1984 (the “Provision for Distribution”) to enable the allocations to be made in full in accordance with the estimates for that year;

            (c) if the total amount available to be appropriated in 2001 or 2002 from the trusts listed in the 1st Schedule is more than the total amount to be allocated towards the estimates for the relevant year in the 2nd Schedule, an amount equal to the amount of the excess will be allocated to the Provision for Distribution.

          (2) Subject to clause 6, the Synod directs that the Standing Committee pass all such ordinances as may be necessary, from time to time, to give effect to the Synod’s intention.

        6. Variation of Appropriations and Allocations Estimates

          (1) If the full amount of an allocation for a line item in the column of the 2nd Schedule headed “2000", “2001" or “2002" -

            (a) is not required for that line item; or

            (b) cannot be applied (in the opinion of the Standing Committee) for the purpose of that line item,

        the remainder of the amount may be allocated by the Standing Committee for any other purpose.

          (2) If the Standing Committee expects that in 2001 or 2002-

            (a) the total amount available to be appropriated from the trusts listed in the 1st Schedule will be less than the total amount estimated to be available for appropriation in that year in Schedule 1; and

            (b) an amount equal to the amount of the deficiency cannot or, in the opinion of the Standing Committee, should not be appropriated from the Provision for Distribution,

        the Standing Committee must -

            (c) promote an ordinance to the next session of the Synod to reduce the allocations intended to be made in the relevant year; and

            (d) give written notice of the promotion of the ordinance to each organisation that may be affected by a reduction in allocations.

        7. Specific Provisions for Allocations

        (1) The amount intended to be allocated in each of the years 2001 and 2002 in line item 14 of Schedule 2 for the purposes of “Anglicare (Sydney) - Planning Consultancy” (as particularised in the relevant line item schedule of the Standing Committee’s report to the Synod) must only be applied to such extent as the regional councils, collectively, pay an amount to Anglicare (Sydney) for the purposes of that project.

        (2) The amount of $25,000 to be allocated in 2000 in line item 13 of Schedule 2 for the purposes of “Moore Theological College - Facilities Master Plan”, (as particularised in the relevant line item schedule of the Standing Committee’s report to the Synod), must only be applied at the direction of the Standing Committee for the purposes of preparing an educational and facilities master plan for Moore Theological College.
