An Ordinance to approve estimates for 1999, to provide for the application of money that will be remitted to the Standing Committee, to vary the trusts of funds and for incidental purposes.

Whereas -

A. The Mission Statement of the Archbishop-in-Council is -

in order to participate in God’s purpose of saving His world.”

B. The estimates which clauses 6A and 9 of the Assessment Authorisation Ordinance 1975 require the Standing Committee to prepare for the year ending 31 December 1999 are in the Schedules to this Ordinance.

C. This Ordinance appropriates funds to meet strategic objectives, commitments and obligations. It does not reflect the total estimated income and expenditure of each recipient of an allocation.

D. It is inexpedient to carry out and observe the respective trusts that apply to the amounts held under the ordinances in the 2nd Schedule to the extent (if at all) to which those trusts are hereby varied.Now the Synod of the Diocese of Sydney Ordains -

1. Name

This Ordinance is the Synod Appropriations Ordinance 1998.

2. Approval of Parish Ministry/Property Costs

For 1999 each parish and provisional parish must make contributions according to the 1st Schedule and at the times required by that Schedule.

3. Adoption of 1998 Synod Estimates

The estimates for 1999 in the column of the 2nd Schedule headed “1999 Estimates” and in the column of the 3rd Schedule headed “1999" are hereby adopted. The estimates in the columns of the 3rd Schedule headed “2000" are estimates only and are not adopted.

4. Directions for Appropriations

(1) Due to circumstances that have arisen since the creation of the trusts that apply to the amounts held under the ordinances in the 2nd Schedule, it is inexpedient to carry out and observe those trusts to the extent (if at all) to which those trusts are hereby varied.

(2) The amounts referred to in subclause (1) must be applied towards the estimated allocations for 1999 in the 3rd Schedule.

(3) The money to be paid under clause 4 of the Diocesan Endowment Ordinance 1984 and remitted to the Standing Committee during 1999 must be applied towards the estimated allocations for 1999 in the 3rd Schedule.

5. Directions for Allocations

(1) The amounts in each of the line items 3, 4, 5, 6, 7, 8, 9 and 10 in the column of the 3rd Schedule headed “1999" must be paid and applied in accordance with the amounts in the column headed “1999" in the schedule applicable to that line item in the Standing Committee’s Report to the Synod.

(2) The amount in line item 11 (“Contingencies”) in the column of the 3rd Schedule headed “1999" must be paid and applied as directed by Standing Committee.

(3) The amount in line item 12 (“Diocesan Endowment - Transfer to Synod reserve”) in the column of the 3rd Schedule headed “1999" must be applied to the Provision for Distribution held by the Glebe Administration Board on the trusts set out in the Diocesan Endowment Ordinance 1984.

6. Presentation and Exchange Ordinance

Clauses 8 and 15 of the Presentation and Exchange Ordinance 1988 apply to the amounts paid or payable under the 1st Schedule.

7. Variation of Allocations

(1) If the money received from the appropriations in the 1st and 2nd Schedules is insufficient to meet the estimated allocations in the 3rd Schedule headed “1999" the Standing Committee must decide which allocations are to be reduced and the extent of the reduction.

(2) If the full amount of an allocation for a line item in the column of the 3rd Schedule headed “1999" -

(a) is not required for that line item; or

(b) cannot be applied (in the opinion of the Standing Committee) for the purpose of that line item, the remainder of the amount may be allocated by the Standing Committee for any other purpose.

8. Sexual Misconduct Protocol

If the money available for the administration of the Protocol issued by the Archbishop for dealing with sexual misconduct by church workers in the Diocese of Sydney is insufficient to meet the costs, the Standing Committee is authorised to raise a levy of up to $500 on each parish and up to $250 on each provisional parish of the Diocese.

1st Schedule: Parish Ministry and Property Cost Recoveries for 1999

A Parish is to pay -

(a) a minimum charge of $8,535 plus

(b) 4.95% of its net receipts over $73,000 for 1997

under the Assessment Authorisation Ordinance 1975 .

A Provisional Parish is to pay -

(a) a minimum charge of $4,268 plus

(b) 4.95% of its net receipts over $73,000 for 1997 under the Assessment Authorisation Ordinance 1975.

Plus the actual superannuation, long service leave, sickness and accident fund and stipend continuance plan costs payable for each Assistant Minister licensed.

But, if the superannuation costs for a person acting as the Minister (under clause 59 of the Church Administration Ordinance 1990) are paid by another parochial unit or body, relief may be sought and granted to the extent of the actual superannuation contribution for 1 Assistant Minister or Lay Minister.

Payable in 10 monthly instalments from 1 March 1999.
