Synod Appropriations Ordinance 1996

        No 39, 1996

        An Ordinance to approve estimates for 1997, to provide for the application of money which will be remitted to the Standing Committee, to vary the trusts of funds and for incidental purposes.

        Whereas -

        A. The Mission Statement of the Archbishop-in-Council is -

        “Our mission is to glorify God through Jesus Christ by developing individuals and churches who are -

        · observably God’s people

        · pastorally effective

        · evangelistically enterprising

        · genuinely caring

        · dynamically Anglican

        in order to participate in God’s purpose of saving His world.”

        B. The estimates which clauses 6A and 9 of the Assessment Authorisation Ordinance 1975 require the Standing Committee to prepare for the year ending 31 December 1997 are in the Schedules to this Ordinance.

        C. This Ordinance appropriates funds to meet strategic objectives, commitments and obligations. It does not reflect the total estimated income and expenditure of each recipient of an allocation.

        D. The allocations in this Ordinance show the overall priorities by the order and total of each line item in the 3rd Schedule, line 3 being the highest.

        E. It is inexpedient to carry out and observe the respective trusts that apply to the amounts held under the ordinances in the 2nd Schedule to the extent (if at all) to which those trusts are hereby varied.

        Now the Synod of the Diocese of Sydney Ordains -

        Name

        1. This Ordinance is the “Synod Appropriations Ordinance 1996”.

        Approval of Parish Ministry/Property Costs

        2. For 1997 each parish, provisional parish and assisted provisional parish must make contributions according to the 1st Schedule and at the times required by that Schedule.

        Adoption of 1997 Synod Estimates

        3. The estimates for 1997 in the column of the 2nd Schedule headed “1997 Estimates” and in the column of the 3rd Schedule headed “1997" are hereby adopted. The estimates in the columns of the 3rd Schedule headed “1998", “1999" and “2000" are examples.

        Directions for Appropriations

        4. (1) Due to circumstances that have arisen since the creation of the trusts that apply to the amounts held under the ordinances in the 2nd Schedule, it is inexpedient to carry out and observe those trusts to the extent (if at all) to which those trusts are hereby varied.

        (2) The amounts referred to in subclause (1) must be applied towards the estimated allocations in the 3rd Schedule.

        (3) The money to be paid under clause 4 of the Diocesan Endowment Ordinance 1984 and remitted to the Standing Committee during 1997 must be applied towards the estimated allocations in the 3rd Schedule.

        Directions for Allocations

        5. The amounts in line items 3, 4, 5, 6, 8, 9 and 10 in the column of the 3rd Schedule headed “1997" must be paid and applied as directed by the Standing Committee.

        6. The amount in line item 7 in the column headed “1997" of the 3rd Schedule must be paid at the direction of the Regional Council indicated and applied as follows -

        1. Includes appropriate regional administration expenses.

        2. For Assisted Provisional Parishes: F&L Board loans, rates etc.

        Presentation and Exchange Ordinance

        7. Clauses 8 and 15 of the Presentation and Exchange Ordinance 1988 apply to the amounts paid or payable under the 1st Schedule to this Ordinance.

        Variation of Allocations

        8. (1) If the money received from the appropriations in the 1st and 2nd Schedules is insufficient to meet the estimated allocations in the 3rd Schedule, the Standing Committee must decide which allocations are to abate.

        (2) If the full amount for an allocation line item in the column of the 3rd Schedule headed “1997" -

        (a) is not required for that line item; or

        (b) cannot be applied (in the opinion of the Standing Committee) for the purpose of that line item; the remainder of the amount may be allocated by the Standing Committee for any other purpose.

        Sexual Misconduct Protocol

        9. If the money allocated under this Ordinance for the development and administration of the Protocol issued by the Archbishop for dealing with sexual misconduct by church workers in the Diocese of Sydney is insufficient to meet the costs, the Standing Committee is authorised to raise a further levy of up to $500 on each parish of the Diocese.

        References in Other Ordinances

        10. Clause 7 of the Interpretation Ordinance 1985 is amended by inserting the following new subclause after subclause (2) -

        “(3) A reference in another ordinance to an Income and Expenditure Ordinance is a reference to a Synod Appropriations Ordinance.”

        Allocation to Central Ministry Organisations

        11. Of the sum allocated to Central Ministry Organisations beyond the amount recommended in the Standing Committee’s report, $100,000 must be allocated as follows -

        Anglican Youth Department Diocese of Sydney - $50,000

        Anglican Education Commission Diocese of Sydney -$50,000

        1st Schedule: Parish Ministry and Property Cost Recoveries for 1997

        A Parish is to pay a basic charge being -

        (a) the minimum charge of $9,950; or

        (b) 4% of its net receipts for 1995 under the Assessment Authorisation Ordinance 1975 if the net receipts are over $248,750;

        whichever is the greater.

        A Provisional Parish is to pay the minimum charge of $4,975.

        An Assisted Provisional Parish is to pay the minimum charge of $4,975.

        Plus an amount equal to 70% of the actual superannuation and long service leave costs payable for each Assistant Minister licensed.

         

        Plus the actual superannuation and long service leave costs payable for each Assistant Minister licensed.  
        But, if the superannuation costs for a person acting as the Minister (under clause 59 of the Church Administration Ordinance 1990) are paid by another parochial unit or body, relief may be sought and granted to the extent of the actual superannuation contribution for 1 Assistant Minister or Lay Minister. Payable in 10 monthly instalments from 1 March 1997.
