Long Title

An Ordinance to amend the Extra-Parochial Ordinance 1918.

The Synod of the Diocese of Sydney ordains.

Name

1. (1) This Ordinance is the Extra-Parochial Ordinance 1918 Amendment Ordinance 1998.

(2) The Extra-Parochial Ordinance 1918 is in this Ordinance referred to as the “1918 Ordinance”.

Editorial Amendment

2. The 1918 Ordinance is amended -

(a) in clause 1 by omitting the matter “or provisional or parochial district” wherever occurring; and

(c) in clause 3 by inserting the matter “and ‘parish’” after the matter “‘Archbishop-in-Council’”.

Amendment re Property/Properties

3. The 1918 Ordinance is amended -

(a) in the Long Title by omitting the matter “and institutions” and by inserting instead the matter “, institutions and properties;

(b) in clause 1 by inserting the matter “or property” after the matter “charitable institution”;

(c) in clause 1 by omitting the matter “or institution” wherever occurring and by inserting instead the matter “, institution or property”; and

(d) in clause 2 by omitting the matter “or institutions” and by inserting instead the matter “, institutions or properties”.

Amendment re Chaplains

4. Clause 2 of the 1918 Ordinance is amended by omitting the matter “Clerk in Holy Orders” and by inserting instead the matter “person”.

Amendment re the Archbishop and Regional Councils

5. Clause 1 of the 1918 Ordinance is amended -

(a) by inserting the matter “(1)” after the clause number; and

(b) by adding the following subclause at the end of the clause -

“(2) In addition to the authority given to the Archbishop-in-Council by subclause (1) and subject to the first proviso of that subclause, the Archbishop, at the request of a Regional Council, may declare part of a region as extra-parochial and, if requested so to do by a Regional Council, may declare that a part of the Region shall cease to be extra-parochial.”

Amendment re Temporary Reversion

6. Clause 4 of the 1918 Ordinance is omitted and the following clause is inserted instead -

“4. For so long as a building, institution or property is extra-parochial, it is taken to be outside the limits of any parish.”

Saving Clause

7. Nothing in this Ordinance affects any declaration or appointment made under the 1918 Ordinance prior to the date on which this Ordinance receives assent.
