An Ordinance to provide for the reclassification of assisted provisional parishes.
The Synod of the Diocese of Sydney Ordains -
Name of Ordinance
1. This Ordinance is the Assisted Provisional Parishes (Reclassification) Ordinance 1997.
Reclassification
2. Any parochial unit which, but for this clause, would have been an assisted provisional parish on 1 January 1998 is taken to have been reclassified as a provisional parish on that day.
Amendment of Ordinances
3. (1) With effect from 1 January 1998 the ordinances named in the Schedule are amended in the manner specified in the Schedule.
(2) With effect from 1 January 1998, a reference in any other ordinance to an assisted provisional parish is taken to be a reference to a provisional parish.
Previous Acts and Liabilities
4. Nothing in this Ordinance affects or shall be taken to affect -
(a) any act done prior to 1 January 1998 under any ordinance amended, or taken to be amended, by this Ordinance; or
(b) any liability or obligation incurred prior to such date.
Schedule
Assessment Authorisation Ordinance 1975
1. In the Long Title the matter “parishes, provisional parishes and provisional districts” is deleted and the following matter is inserted instead -
“parishes and provisional parishes”.
2. In the Preamble the matter “parishes provisional parishes and provisional districts” is deleted and the following matter is inserted instead -
“parishes and provisional parishes”.
3. In the definition of “parochial unit” in clause 2(d) the matter “parish, provisional parish or assisted provisional parish” is deleted and the following matter is inserted instead -
“parishes and provisional parishes”.
4. Paragraph C. of the Schedule is deleted.
5 In paragraph D. of the Schedule the matter “parish rebate, provisional parish rebate and assisted provisional parish rebate” is deleted and the following matter is inserted instead -
“parish rebate and provisional parish rebate”.
Church Administration Ordinance 1990
1. In the definition of “minister” in clause 2(1) the matter “or an assisted provisional parish” is omitted.
2. In the definition of “parish” in clause 2(1) the matter “parish, provisional parish or assisted provisional parish” is deleted and the following matter is inserted instead -
“parish or provisional parish”.
3. Part 7 is deleted.
Deaconesses, Readers and Other Lay Persons Ordinance 1981
1. Paragraph (c) of the definition of “minister” in clause 1(1) is deleted.
2. In clause 1(1) the definition of “parish” is deleted and the following is inserted instead -
“‘parish’ means a parish and a provisional parish in the Diocese.” .
Parishes Ordinance 1979
1. In the definition of “ecclesiastical district” in paragraph (e) of clause 1(1), the matter “parish, provisional parish or assisted provisional parish” is deleted and the following matter is inserted instead -
“parish or provisional parish”.
2. The definition of “assisted provisional parish” in paragraph (i) of clause 1(1) is deleted.
3. Paragraphs (aa) and (ca) of clause 4(1) are deleted.
4. Clause 4(8A) is deleted.
5. In clause 4(9) the matter “or (8A)” is deleted.
6. In clause 7(1) -
(a) the matter “or an assisted provisional parish” is deleted; and
(b) the final sentence is deleted.
Synod Membership Ordinance 1995
1. In the heading to clause 11 the matter “or Assisted Provisional Parish” is deleted.
2. In clause 11 the matter “and an Assisted Provisional Parish” is deleted.
3. In the Dictionary the definition of “Assisted Provisional Parish” is deleted.
4. In the Dictionary the definition of “Parochial Unit” is deleted and the following is inserted instead -
“‘Parochial Unit’ means a Parish and a Provisional Parish.”
