        An Ordinance to amend the Assessment Authorisation Ordinance 1975.

        The Synod of the Diocese of Sydney Ordains -

        Name of Ordinance

        1. This Ordinance is the Assessment Authorisation Ordinance 1975 Amendment Ordinance 1998.

        Amendment of the Assessment Authorisation Ordinance 1975

        2. The Assessment Authorisation Ordinance 1975 (the “Principal Ordinance”) is amended as follows -

        (a) before the heading to clause 1, the following heading is inserted -

        “Part 1 - Introduction”;

        (b) clause 1(1) is deleted and the following is inserted instead -

        “(1) This Ordinance is the Assessments and Charges Ordinance 1975";

        (c) in the heading to clause 6 the following is inserted after the word “Assessments” -

        “and Charges”.

        (d) in clause 6 the following matter is inserted after the word “assessment” -

        “or charge”

        (e) after clause 6 the following is inserted -

        “Part 2 - Assessments”;

        (f) in clause 6A -

        (i) the matter “(1)” is inserted before the word “Subject”;

        (ii) the following matter is inserted after the matter “in each year thereafter” -

        “until 31 December 1999”;

        (iii) the matter “(2)” is inserted before the commencement of the second sentence; and

        (iv) the following matter is inserted after the matter “each ordinary annual session of Synod” in the second sentence -

        “up to and including the 3rd ordinary session of the 44th Synod”;

        (g) clause 7 is deleted;

        (h) clauses 7A and 8 are renumbered and relocated as clauses 14 and 15 respectively;

        (i) in clause 9(1) the following matter is inserted after the matter “each ordinary session of the Synod” -

        “up to and including the 3rd ordinary session of the 44th Synod”;

        (j) after clause 9 the following matter is inserted (with existing clauses 10, 11 and 12 renumbered as clauses 16, 17 and 18 respectively) -

        “Part 3 - Cost Recoveries Charge”

        Parochial Units to pay Cost Recoveries Charge

        10. (1) For the year 2000, and each financial year thereafter, each parochial unit must pay a cost recoveries charge in respect of Ministry and Property Costs specified or determined in accordance with an ordinance referred to in clause 11.

        (2) In this Part, “Ministry and Property Costs” means all costs, expenses, charges or contributions which, in the opinion of the Standing Committee, have been incurred or will be incurred on behalf of or in relation to a parochial unit or any member of the clergy licensed to a parochial unit and, without limiting the generality of the foregoing, includes -

        (a) the costs of effecting insurances under the Church Insurances Ordinance 1980 for parochial units and any officers or employees of parochial units;

        (b) superannuation contributions for members of the clergy licensed to parochial units;

        (c) costs and expenses of, or incidental to, the maintenance of stipend continuance insurance for members of the clergy licensed to parochial units;

        (d) contributions to the fund established by the Sydney Diocesan Sickness and Accident Fund Ordinance 1969;

        (e) contributions for long service leave for members of the clergy licensed to parochial units; and

        (f) the costs of maintaining and operating the Property Trust’s titles registry.

        Determination of Charge

        11. (1) The Standing Committee must prepare for the first ordinary session of the 45th Synod and the first ordinary session of each Synod thereafter a proposed ordinance for adoption by the Synod which -

        (a) specifies the cost recoveries charge in respect of Ministry and Property Costs to be paid by each parochial unit in each of the following 3 financial years, or the method or methods by which such charge may be determined by the Standing Committee; and

        (b) authorises the Standing Committee to apply the cost recoveries charges paid by parochial units in a financial year toward the Ministry and Property Costs.

        (2) The Standing Committee must arrange for the distribution of a copy of the proposed ordinance to all members of the Synod not less than 14 days before the first day of the session.

        12. If, in relation to a financial year, the Standing Committee expects that the total of the cost recoveries charges to be received from parochial units will be insufficient to meet the total of the Ministry and Property Costs for that year, it may bring to the Synod an ordinance containing a proposal to meet that insufficiency.

        Part 4 - Other Provisions

        Payment of Assessments and Charges

        13. All assessments or cost recovery charges imposed by or pursuant to an ordinance of Synod, unless the ordinance otherwise directs, shall be payable by 10 equal monthly instalments, the first due and payable on 1 March and subsequent instalments due and payable on the first day of each succeeding month.”;

        (k) in clause 14 (formerly clause 7A) -

        (i) after the matter “Assessment” in the heading the words “or Charge” are inserted;

        (ii) after the word “assessment” in the first sentence the words “or charge” are inserted; and

        (iii) after the word “assessments” in the second sentence the words “or charges” are inserted.

        (l) in clause 15 (formerly clause 8) -

        (i) after the word “Assessments” in the heading the words “and Charges” are inserted”;

        (ii) in subclauses (2A), (3) and (4) after the word “assessments” wherever appearing the words “and charges” are inserted; and

        (iii) in subclause (2B) after the word “assessment” where appearing the words “and charge” are inserted.

        (m) in clause 16 (formerly clause 10) the words “or charged” are inserted after the word “assessed”.
