Administrator Ordinance 1999

        An Ordinance to supplement “An Ordinance to appoint a person for the purposes of the 11th Section of the Constitutions and the 39th Section of the Anglican Church of Australia Trust Property Act 1917” (assented to 25 November 1921).

        Whereas

        A. The 11th Article in the Schedule to the Anglican Church of Australia Constitutions Act 1902 enables the synod of a diocese by ordinance to appoint a person who, in the circumstances recited in that Article, shall exercise the powers vested in the bishop of the diocese under that Act.

        B. The powers referred to in recital A include those exercised by the bishop of a diocese under Section 8 of the Schedule to the Anglican Church of Australia Constitution Act 1961.

        C. Section 39 of the Anglican Church of Australia Trust Property Act 1917 enables the synod of a diocese by ordinance to appoint a person who, in the circumstances recited in that section, may exercise the powers and functions and may also do and make all or some of the things referred to therein in the place of the bishop of the diocese under that Act.

        D. By an ordinance in 1921 the Synod of the Diocese of Sydney provided for the appointment of a person to exercise the said powers and functions in the various circumstances referred to in recitals A and C of this Ordinance, such person to be appointed at the first session of each Synod.

        E. Such person is referred to as “the Administrator”.

        The Synod of Diocese of Sydney Ordains -

        1. Name of Ordinance

        This Ordinance is the Administrator Ordinance 1999.

        2. Appointment

        Bishop Peter Watson is hereby appointed as the person by whom the said powers and functions are to be exercised in pursuance of the 11th Article in the Schedule to the Anglican Church of Australia Constitutions Act 1902, and in pursuance of Section 39 of the Anglican Church of Australia Trust Property Act 1917.

        3. Notwithstanding the provisions of the Ordinance entitled “An Ordinance to appoint a person for the purposes of the 26th Section of the Constitutions and the 39th Section of the Anglican Church of Australia Trust Property Act 1917”, in the event of the death, incapacity, absence from the State or unwillingness to act of Bishop Watson, the person who is to act for the purposes set out in clause 1 of this Ordinance shall be Bishop Paul Barnett or such other person as shall at the time be the next senior assistant bishop licensed in the Diocese able and willing to act.

        4. Session of Synod to elect an Archbishop

        If Bishop Watson or Bishop Barnett is a nominee in an election under the Archbishop of Sydney Appointment Ordinance 1982, at a session of the Synod convened pursuant to that Ordinance, the Chancellor shall be the President of the Synod or, if he is unable or unwilling to preside, the Advocate or, if he is unable or unwilling to preside, such person as the Synod may elect.
